국문초록

사회가 복잡해지고 인구의 도시집중화 현상 그리고 산업의 발전으로 화재뿐 아니라 재난의 발생 빈도가 증가하고 있다. 소방업무는 화재를 벗어나 현대사회에서 재난에 대한 대응이 무엇보다 중요해져 가고 있다. 소방업무는 화재와 재난 외에 인명구조 등 다양한 형태로 변화되어 가고 있으며, 국민의 소방요구는 증가해 자고 있다. 소방업무는 기존에 국가기관 등 공적기관에서 이를 담당하였으나, 소방업무의 증가는 공적업무의 한계를 가져왔다. 소방업무에 대한 공적기관의 한계를 극복하기 위해 자율적인 의용소방대를 설치하여 소방업무의 보조적인 역할을 담당하게 하고 있다.

이러한 소방업무를 담당하는 의용소방대는 자발적인 지원 하에 조직이 구성되고 소방기관의 소방업무에 대한 보조적인 역할을 담당해 오고 있다. 그러나 소방현장에서 의용소방대가 수행하는 역할은 단순한 보조적인 역할의 범위에서 벗어나 직접적으로 소방활동을 담당하는 경우도 있다. 이처럼 의용소방대가 수행하는 업무는 소방활동으로 소방현장에서의 역할을 매우 중요한 지위를 가지고 있다.

의용소방대가 수행하는 역할이 소방현장에서 중요함에 따라 현행 법체계는 의용소방대에 대한 근거법률로 「의용소방대 설치 및 운영에 관한 법률」을 제정하여 운영하고 있다. 이 법률은 의용소방대의 근거와 운영에 관한 법률이나 의용소방대가 화재 현장 등에서 수행하는 역할을 단순히 보충적으로 규정하고 있을 뿐 아니라 의용소방대의 법적 지위를 명확히 규정하지 않은 한계를 가지고 있다. 또한 의용소방대가 소방현장에서 받은 피해와 소방활동으로 인해 타인 및 재산 등에 가한 피해 등에 대하여 구제책을 구체적으로 마련하지 않고 있다. 이러한 의용소방대에 관한 법률이 가지는 한계에 의해 의용소방대의 업무 수행이 원활히 수행되지 못하는 문제를 가지고 있다.

따라서 본 연구는 의용소방대가 업무의 효율적 수행을 위해서 현행 법체계에 대한 문제점을 검토하여 그 개선방안을 제시하였다.

Abstract

With the complexity of society, the urbanization of the population and the development of industry, the incidence of disasters as well as fires is increasing. Away from firefighting, response to disasters is becoming more important in modern society. In addition to fires and disasters, fire-fighting work is changing in various forms, such as lifesaving, and the people's demand for firefighting is increasing. Fire fighting work was previously handled by public agencies such as state agencies, but the increase in firefighting work has brought limitations to public work. In order to overcome the limitations of the public organs in the work of firefighting, an autonomous volunteer fire brigade is being set up to play an auxiliary role in the fire fighting work.

The Medical Fire Brigade, which is responsible for these firefighting tasks, has been organized with voluntary support and has played an auxiliary role in the fire fighting work of the fire protection agencies. However, in some cases, the role played by the volunteer fire brigade in the field of fire goes beyond the scope of a simple auxiliary role and is directly responsible for firefighting activities. As such, the work performed by the Volunteer Fire Brigade is a firefighting activity, which has a very important status in its role in the fire fighting scene.

As the role played by the volunteer fire brigade is important in the field of firefighting, the current legal system has established and operated the "Act on the Installation and Operation of Volunteer Fire Brigades" as the basis for the volunteer fire brigade. The Act on the Basis and Operation of volunteer fire brigades or the Role of the volunteer fire brigade at the scene of a fire is not only supplementary to the role that the volunteer fire brigade plays at the scene of a fire, but also has limitations that do not clearly define the legal status of the volunteer fire brigade. In addition, the volunteer fire brigade does not provide specific remedies for the damage it has received at the scene of the fire fighting and the damage it has inflicted on others and property due to its firefighting activities. Due to the limitations of the law on medical fire brigades, there is a problem that the work of the volunteer fire brigade cannot be carried out smoothly.

Therefore, this study examined the problems with the current legal system in order for the volunteer fire brigade to carry out its work efficiently and proposed ways to improve it.
