본 연구에서는 베트남의 2050 탄소중립 기본방향 중 순환경제 확대 및 산업의 지속가능성 제고와 관련하여 현재 진행중인 베트남의 2025 베트남 폐기물처리에 관한 국가 전략 및 비전 2050정책시행 중 폐기물의 관리 및 자원재활용 관련된 베트남의 주요 법령과 정책 등을 검토하고 우리나라와의 법제 협력방안을 도출하였다. 국제사회는 기후변화 문제를 해결하기 위해 저탄소 녹색성장이라는 공통된 목표를 실천하기 교토의정서 채택에 이어, 파리협정을 2015년 채택하였다. 파리협정을 통해 기후변화 대응 정책의 장기적 비전 관점에서 각 당사국에서 장기 저탄소 발전전략(LEDS, Long-term Low greenhouse gas Emission Develope Strategy)을 2020년까지 수립하도록 권고하고 있다. 우리나라도 국제사회의 기후변화 노력에 동참하기 위해 장기 저탄소 발전전략을 수립하기로 결정하였으며, 이를 실천하기 위해 학계, 산업계, 시민사회 등 다양한 분야의 전문가가 참여하는 ‘2050 저탄소 사회 비전 포럼’을 구성하고 다양한 2050년 국가 온실가스 감축 목표와 비전을 검토하고 실천중이다. 이러한 상황속에서 최근 우리나라의 주요 무역국가인 베트남 역시도 2050까지 저탄소녹색성장 계획을 발표하면서 녹색성장분야의 법제도 개선을 밝히고 있으나. 이에 대한 구체적인 실천방향에 있어서 어려움을 겪고 있으며 현재 우리나라의 주요 국가기관 및 민간기업 등과 교류협력하면서 우리나라의 환경법 분야의 법제도를 받아들이고 있다. 그중에서도 우리나라가 현재 실천 중인 탄소중립 기본방향 중 순환경제 확대를 위한 산업의 지속가능성 제고와 관련하여 폐기물 부문의 탄소중립을 위해서는 자원의 채취, 제품의 생산 및 유통, 소비, 폐기물 재활용과 처리 등 전 과정에서 자원의 효율성을 극대하여 자원 투입의 수요를 줄이고 자원 선순환 체계를 구축하여 폐기물 발생을 근본적으로 줄이는 것이 필요하다. 또한, 발생한 폐기물은 최대한 유용한 물질로 전환하거나 에너지로 재사용하고, 재활용되지 못한 폐기물은 온실가스 배출이 적은 친환경적 방법으로 처리가 필요하다. 이와 함께 폐기물 부분에서 가장 문제가 되는 플라스틱과 종이 및 고형폐기물을 줄이고, 탈플라스틱 사회 전환 대책의 별도 마련이 요구되는 상황으로 나타났다.

현재 베트남은 폐기물 관리 및 자원재활용과 관련하여, 현재 다양한 법령과 정책이 시행중인 상황에서, 저탄소 녹색성장의 실천을 위해 2000년 초반부터 폐기물 관리 및 자원재활용 관련 법령과 정책을 적극적으로 실천하였다. 베트남의 경우 주요 국가의 폐기물을 수입하는 국가에서 이러한 폐기물의 관리 및 자원재활용을 통해 온실가스의 배출을 줄이고 이를 저탄소 기술과 접목시키려는 다양한 노력이 진행중이다. 이러한 상황에서 폐기물 관련 행정조직 강화, 2050 비전 수립, 고형폐기물 발생 감축과 재활용 정책, 외국인 투자 촉진에 있어서 우리나라와 베트남의 법제협력이 필요한 것으로 나타났다.

Abstract

This study examines the national strategy for Vietnam's 2025 Vietnam waste disposal and the major laws and policies related to waste management and resource recycling during the implementation of Vision 2050 policy regarding the expansion of the 2050 carbon neutral basic direction in Korea. The international community adopted the Paris Agreement in 2015 following the adoption of the Kyoto Protocol to implement a common goal of low-carbon green growth to address climate change issues. The Paris Agreement recommends that long-term low-greenhouse gas emission development strategies (LEDS) be established by 2020 in terms of the long-term vision of climate change response policies.

Korea has also decided to establish a long-term low-carbon development strategy to participate in climate change efforts by the international community, and to implement it, it has organized a "2050 Low-carbon Social Vision Forum" involving experts from various fields such as academia, industry, and civil society.

In order to improve the substantiality of the industry to expand the net environment system among Korea's 2050 carbon neutral basic directions, it is necessary to maximize the efficiency of resources in the entire process, such as collection, production and distribution, consumption, waste recycling and disposal. In addition, waste generated needs to be converted into the most useful materials or reused as energy, while non-recycled waste needs to be treated in an eco-friendly way with less greenhouse gas emissions. In addition, it is necessary to reduce plastic, paper, and solid waste, which are the most problematic in the waste sector, and to come up with separate measures to transform the society of plastic.

With various laws and policies currently in place regarding waste management and resource recycling in Korea, Vietnam has actively implemented laws and policies related to waste management and resource recycling since early 2000 to practice low-carbon green growth. In Vietnam, various efforts are underway to reduce greenhouse gas emissions and integrate them with low carbon technologies through the management and resource recycling of waste from major countries. In this situation, it was found that legal cooperation between Korea and Vietnam is necessary to strengthen waste-related administrative organizations, establish a vision for 2050, reduce solid waste, make recycling policies, and promote foreign investment.
